Appeal Court reserved judgment in a lawsuit seeking the disqualification of all Enugu PDP candidates in the 2023 polls.

The Enugu Court of Appeal, led by Ndukwe Anyanwu, has deferred the ruling on a case requesting the disqualification of all Peoples Democratic Party (PDP) candidates from the 2023 elections.

Comrade Chika Emmanuel Idoko of the African Democratic Congress (ADC) filed the suit claiming that the PDP violated Section 77 of the Electoral Act. Despite a Federal High Court judgement in Enugu stating that the petitioner had no standing to pursue the case, Idoko moved the case to the Court of Appeal. Idoko argued that the PDP primary election violated Section 77 of the Electoral Act, and therefore, should be nullified.

He also contended that the party should be penalized based on Section 84 of the same Act. The Federal High Court had previously ruled that only a member of the same political party could sue for such a violation, but Idoko argued that such a rule was not explicitly stated in the Electoral Act or Constitution of the Federal Republic of Nigeria.

At the Court of Appeal, Counsel to the Appellant, C I Odo Esq, urged the court to allow the appeal of the appellant. The counsels to the respondents/cross-appellants adopted their cross-appellants briefs of argument and their respondents brief of argument and urged the court to dismiss the appeal and grant the reliefs sought for in their cross-appeal. The Court has reserved judgement and will inform the parties of the date of the verdict.
