Amazon Web Services (AWS) Representative Testifies at Presidential Election Petition Court, denies any technical glitch on the election day.
The Independent National Electoral Commission (INEC) had engaged AWS to provide technical support during the general elections. Ogar appeared as the 7th witness in the petition filed by the Labour Party and its candidate, Mr. Peter Obi, seeking to nullify the election of President Bola Tinubu from the ruling All Progressives Congress (APC).
Today, the Presidential Election Petition Court (PEPC) in Abuja heard testimony from Mpeh Clarita Ogar, a representative of Amazon Web Services Incorporated. The Independent National Electoral Commission (INEC) had engaged AWS to provide technical support during the general elections. Ogar appeared as the 7th witness in the petition filed by the Labour Party and its candidate, Mr. Peter Obi, seeking to nullify the election of President Bola Tinubu from the ruling All Progressives Congress (APC).
Led in evidence by Mr. Patrick Ikweto, SAN, a member of Obi’s legal team, Ogar contradicted INEC’s position. She stated that AWS did not record any technical glitches in the country on the day of the presidential election, February 25. INEC had previously blamed technical issues for its inability to electronically transmit election results in real-time using the Bimodal Voter Accreditation (BVAS) machines.
As a cloud engineer and architect, Ogar presented six volumes of reports from AWS servers hosted in 33 regions worldwide, including North America, South America, Asia, Africa, Oceania, and Europe. According to her testimony, there were no technical glitches across these regions on February 25, 2023.
In addition to her witness statement made on June 19, Ogar tendered her curriculum vitae and appointment letter as evidence before the court. Despite objections from all respondents, a five-member panel led by Justice Haruna Tsammani admitted all the documents as exhibits.
The respondents in the petition, marked CA/PEPC/03/2023, include INEC, President Tinubu, Vice President Kashim Shettima, and the APC. The court adjourned the proceedings until Tuesday to allow the respondents to cross-examine the witness.
Earlier in the case, the petitioners accused INEC of withholding electoral documents necessary to support their allegation of rigging in favor of Tinubu. Mr. Jubril Okutekpa, SAN, counsel for the petitioners, expressed frustration with INEC’s refusal to provide the requested exhibits, despite multiple letters sent to the Commission.
In response, Mr. Abubakar Mahmoud, SAN, representing INEC, refuted the allegation, stating that the petitioners never raised the issue with him prior to the proceedings. Mahmoud emphasized that INEC would provide the requested documents as long as the proper procedures were followed.
The court will continue to address these issues as the proceedings unfold, with the petitioners seeking the necessary evidence to support their claims of electoral irregularities.
